These terms apply to your use of blackforgesports.com (the “Site”), operated by BlackForge Sports, LLC (“BlackForge Sports,” “we,” “us”). By using the Site you agree to them. The BlackForge Sports mobile app has its own App Terms of Use, which govern the app.

The Site and early access

The Site describes a product that is in development. Features, availability and timing may change, and joining the early-access list does not guarantee access. Screens shown are from a pre-release build with demo data.

Who may use the Site

The Site and its early-access form are for adults 18 and over. Do not submit information about a child.

Acceptable use

Do not misuse the Site. That includes attempting to disrupt or gain unauthorized access to it, scraping it at a scale that burdens it, submitting false or someone else’s information, or using it for anything unlawful.

Our content

The Site’s text, design, graphics, screenshots, and the BlackForge Sports™ and BlackForge names and marks belong to us or our licensors. You may view the Site for your own personal use, but you may not copy, modify or distribute it or use our marks without written permission.

Information only, not advice

Content on the Site is general information. Descriptions of arm-care or workload features are advisory and are not medical advice. A coach and a doctor should make decisions about an athlete’s health and participation.

Third-party links

The Site may link to third-party sites. We do not control them and are not responsible for their content or practices.

Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, BlackForge Sports, LLC and its members, managers, officers and affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limits, so these may not apply to you.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction over disputes, except where the law of your place of residence requires otherwise.

Changes

We may update these terms and will post the new version here with a new effective date. Continued use of the Site means you accept the update.
